Personal Data & Privacy Statement

This Privacy Policy Statement (“Statement”) covers the use and collection of data on the platform at https://wwwlab.wisespotgroup.com (“Platform”).  The Platform is an online job application platform organized by WiseSpot Company Limited (“WiseSpot”), and any of its related bodies or affiliates (referred to as members of the “WiseSpot Group”).

WiseSpot endeavors to ensure that all our collection, transmission, storage and usage of Personal Data shall be carried out in compliance with the Personal Data (Privacy) Ordinance, Cap 486 of the Laws of the HKSAR (“PDPO”), as amended from time to time.

The term “Personal Data” shall have the meaning ascribed to it by the PDPO. Certain terms that are capitalized in this Statement are defined and have the meaning applied to them in this Statement and in our Terms & Conditions of Service (“T & C”).

This Statement explains WiseSpot’s policies and practices regarding what Personal Data it collects about individuals accessing the Platform, why it collects this information and what it does with the information collected. It also explains WiseSpot’s  policies and practices regarding the handling of Personal Data that may have been created, inputted, submitted, posted, transmitted, stored or displayed on the Platform.

We take your privacy seriously and are committed to protecting your personal data. Any information you provide will be treated with the utmost confidentiality and will only be used for the purpose of assessing your application for employment opportunities within WiseSpot. Your data will be stored securely and will not be shared with any third parties. We will retain your information for a period of six months, after which it will be securely deleted from our systems.

Persons covered by this Statement

This Statement is applicable to visitors to the Platform (“Visitors”), including individuals (“Individual(s)”) considering the use of, or using, the Service.

Collection and Use of Personal Data

All data collection from the Platform and the use of such data collected in accordance with this Statement is to enable WiseSpot to provide communication in the course of regular job application activities associated with our Service. In particular:

  1. Personal Data is collected from an Individual to enable WiseSpot, upon request,
  2. To process an Individual’s registration(s) to events and activities organized by WiseSpot on the Platform;
  3. To assess your suitability for the vacancy for which you have applied for and, if you are selected, to determine the preliminary remuneration and benefits package to be offered to you, and other directly related matters in the recruitment process
  4. To receive job notifications organized by WiseSpot
  5. To identify and verify the Individual as a user of the Platform;
  6. To handle and respond to an Individual’s enquiry and/or feedback and to contact him/her when necessary;
  7. To send information and invitations to the Individual on upcoming events and activities hosted on the Platform; and
  8. To enable the Individual to access their account information and manage their account following registration on the Platform.
  9. Individuals under the age of 18 should obtain consent from their parent or guardian before providing WiseSpot with his/her personal data.
  10. WiseSpot shall indicate mandatory Personal Data required to be provided by an Individual, without which WiseSpot cannot provide its Service.
  11. Visitors are not required to provide any Personal Data if he/she is only viewing the Platform and not accessing or using any Service. Otherwise, provision of his/her name and at least one of the following contact details are mandatory for WiseSpot to provide its Service:
  12. Postal address, or
  13. Email address, or
  14. Telephone number.
  15. Personal Data collected from Individuals may be used by WiseSpot, and WiseSpot Group for:
  16. Receiving job alerts;
  17. Provisioning of follow-up of job applications; and
  18. Meeting obligations, requirements or arrangements, whether legal or voluntary, of WiseSpot Group to comply with, or in connection with:
  • any law, regulation, judgment, court order, voluntary code, sanctions regime, within or outside HKSAR, existing currently and in the future (“Laws”);
  • any guidelines, guidance or requests given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Hong Kong existing currently and in the future and any international guidance, internal policies or procedures;
  • any present or future contractual or other commitment with local or foreign legal, regulatory, judicial, administrative, public or law enforcement body, or governmental, tax, revenue, monetary, securities or futures exchange, court, central bank or other authorities, or self-regulatory or industry bodies or associations of financial service providers or any of their agents with jurisdiction over all or any part of WiseSpot (together the “Authorities” and each an “Authority”);
  • any agreement or treaty between Authorities;
  • Complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing data and information between members of the WiseSpot Group and/or any other use of data and information in accordance with any programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;
  • Conducting any action to meet obligations of WiseSpot or any member of the WiseSpot Group to comply with Laws or international guidance or regulatory requests relating to or in connection with the detection, investigation and prevention of money laundering, terrorist financing, bribery, corruption, tax evasion, fraud, evasion of economic or trade sanctions and/or any acts or attempts to circumvent or violate any Laws relating to these matters;
  • Meeting any obligations of WiseSpot or any member of the WiseSpot Group to comply with any demand or request from the Authorities;
  • In conjunction to any other purposes as may be separately notified to or agreed with an individual, including the purposes stated in any special terms and conditions and in applications for the supply of specific goods and services; or
  • In conjunction to any other purposes directly related to the above.
  1. WiseSpot will not transfer Personal Data to others except for the specific data transferees mentioned in this section.

Types of Personal Data Collected

Types of Personal Data collected by WiseSpot may include (but not limited to) the following:

  1. Personal information and contact information such as name, gender, contact information including mailing/postal address(es), email address(es) and contact phone number(s); and
  2. Business information such as company name and position;

Confidentiality, Disclosure and Security of Personal Data

  1. Data held by WiseSpot relating to an individual will be kept confidential, but WiseSpot may provide such information to the following parties (whether within or outside Hong Kong) for the purposes set out above:
  2. Any Authorities;
  3. Any other person or company who is under a duty of confidentiality to WiseSpot including any provided he/she is able to prove the right to the data and has undertaken to keep such information confidential; iv Persons who may be entitled to disclosure under circumstances described in Part VIII of the PDPO (meaning Personal Data exempt from Data Protection Principal 3 of the PDPO);
  4. Any agents, contractors, sub-contractors, service providers or associates of WiseSpot;
  5. Any person to whom WiseSpot or any member of the WiseSpot Group is under an obligation or required or expected to make disclosure;
  6. Any member of the WiseSpot Group involved in and/or relevant to the selection process including designated staff members of the Administration and Human Resources Department, relevant hiring department head or his/her delegates(s)
  7. WiseSpot’s human resources department are under a duty of confidentiality and are contractually bound to use your Personal Data in connection with the purposes specified above, and not for their own purposes (including direct marketing).
  8. WiseSpot have implemented, based upon appropriate physical, electronic and managerial measures and controls to safeguard all Personal Data provided by Individuals and to secure the transmission of such data to the parties listed above. Individuals’ Personal Data are only accessible by WiseSpot’s own personnel or the personnel of the parties listed above for the purposes specified above. WiseSpot’s own personnel will be instructed to observe duty of confidentiality and the terms of this Statement when accessing your Personal Data and handle Personal Data only in accordance with this Statement.
  9. Any questions, comments, suggestions or information (including materials or data inputted, submitted, uploaded, posted, disclosed, displayed, linked to or otherwise made available on the Platform, sent or posted to the Platform by individuals) will be considered as voluntarily provided to the WiseSpot on a non-confidential, non-private, publicly available and non-proprietary basis. WiseSpot reserves the right (without any obligation, without any charge and without any liability whatsoever to WiseSpot, its officers, personnel, agents, and without giving any notice to the Individuals who provided them to:
  10. To use, reproduce, disclose, transmit, publish and/or post elsewhere such information freely, including passing it to any associated company for example, in connection with the development, manufacturing and marketing of products and services and to meet customer needs, and
  11. To validate data provided or made available using generally accepted practices including, in accordance with the PDPO, requiring review of original documentation before the Personal Data may be used.
  12. All reasonable efforts are made to ensure that any Personal Data held by WiseSpot is stored in a secure and safe place.

Transfer of Personal Data Outside Hong Kong

If necessary, WiseSpot may transfer the Personal Data to places outside of Hong Kong for carrying out the purposes, or the directly related purposes specified above. All the transfer of those Personal Data will be carried out in compliance with the requirements of the PDPO. As Personal Data may be stored or processed in another jurisdiction, it may be accessible to law enforcement and national securities of that jurisdiction.

Retention of Personal Data

Unless there is a mandatory legal requirement for WiseSpot to keep your Personal Data for a specified period, WiseSpot will only retain your Personal Data for as long as necessary to fulfill the purposes specified above for which the Personal Data was originally collected. WiseSpot will periodically redact, purge, anonymize or destroy unnecessary Personal Data in our system in accordance with our internal procedures.

Use of Cookies

  1. WiseSpot may use cookies on the Platform and systems directly associated with the Platform or Service for the following purposes:
  2. Enhancing security;
  3. Build online visitor profiles; or
  4. Any new purpose that WiseSpot deems necessary to enable the provision of updates relating to the Platform or Service.
  5. Cookies enable the Platform to remember you and your preferences when you visit the website and enable us to tailor the Platform to your needs. Cookies do not identify you personally. However, if Individuals want to disallow the use of cookies, he/she can do so on his/her own browser. However, if under such circumstances, certain functionalities may not be available.

This Statement only applies to the Platform and no other third-party websites. The Platform may contain links to other websites and pages.

By activating a link explicitly connecting to such non- WiseSpot websites, the Individual acknowledges that he/she is intentionally leaving the Platform and the Service, and that WiseSpot does not exercise control over any Personal Data or any other information the Individual gives to any other entity after such departure. Access to and use of such other websites is at the Individual’s own risk and therefore is advised to refer to the privacy policies of those other locations, if any.

Data Access and Correction

Under and in accordance with the terms of the Personal Data (Privacy) Ordinance (“Ordinance”), any Individual has the right:

  1. to check whether WiseSpot holds data about him and of access to such data;
  2. to require WiseSpot to correct any data relating to him which is inaccurate; and
  3. to ascertain WiseSpot’ policies and practices in relation to data and to be informed of the kind of personal data held by the WiseSpot.

If an Individual has any query in relation to WiseSpot’s privacy policy or he/she wishes to access or correct his/her Personal Data held by WiseSpot, the Individual may contact WiseSpot at the address or email as below marking the communication “Confidential”.

In response, WiseSpot may ask the Individual to provide certain details about himself/herself so that WiseSpot can be ascertain the rightful ownership of the Personal Data under discussion. WiseSpot is required to respond to such requests within 40 days and WiseSpot will endeavor to do so where possible, but WiseSpot may charge the Individual a reasonable fee for doing so as permitted by the PDPO.
